In most states, including Georgia, representation is established by who is paying the commission to the agent. So, because the seller is paying the full real estate commission to both the buyer’s agent and seller’s agent, the law says that the buyer does not have representation UNTIL that state that they want representation by hiring the agent in writing. This agreement is free to the buyer and shifts the burden of representation by the buyer’s agent to representing the buyer.

Simply put, if you don't hire an agent to represent you in the process - which is free to you, the agent works for the person that pays them - the seller. If you want representation, make sure that you have signed paperwork stating that you want your actions and words to be kept in a confidential relationship between you and your agent so that they are prohibited from using your actions and words against you with the seller and/or their agent.

Agreements in Georgia allow you to terminate in writing your status with the agent if you feel that they are not doing a good job for you - basically you don't trust them. So, you would simply fax a form to the office.

This process of hiring an agent to represent you is a MUST when you are buying a home - don't give up your right to free representation. This includes new construction. The on-site agent represents the builder even though they are really nice and helpful to you.
